These Terms of Service ("Terms") govern your use of the W.M. Blain Well Drilling & Pump, Inc. website and the services we provide. Please read them carefully. By using our website or hiring us for well drilling, pump, or water-system work, you agree to these Terms.

2. About Us

W.M. Blain Well Drilling & Pump, Inc. is a licensed water well drilling and pump contractor (Nevada #46498A, California #912877), family-owned and operating across Northern Nevada and Northeastern California since 1958.

3. Services and Estimates

3.1 Service Areas

We provide service across Northern Nevada and Northeastern California, including Carson City, Reno, Sparks, Minden, Gardnerville, Dayton, Fernley, Genoa, and the surrounding Carson Valley and high desert. Service to outlying areas may be subject to travel time or scheduling considerations.

3.2 Estimates and Quotes

Estimates are based on the information available to us at the time and on typical conditions for the area. They are not final invoices. Until we have assessed the site and ground conditions, figures are good-faith approximations.

3.3 Scope of Work

The specific work we will perform, materials used, and price are set out on your written estimate, work order, or invoice. That written document controls if it conflicts with anything on this website.

3.4 Water Is Not Guaranteed

Drilling a well is exploration. While we use decades of local geology experience to give you the best possible chance of a productive well, no driller can guarantee the quantity, quality, or depth of water that will be found at a particular site. You pay for the drilling work performed and the materials used, not for a guaranteed volume of water. We will give you our honest assessment before and during the job.

4. Scheduling & Property Access

You agree to provide safe, reasonable access to the work site for our crew, rig, and equipment, and to identify known hazards. Public underground utilities should be located through the regional one-call system (811 / USA North) before we drill; private, unmarked lines (irrigation, propane, low-voltage, or power to outbuildings) are the property owner's responsibility to identify. Weather, equipment, and ground conditions can affect scheduling on drilling work.

5. Payment Terms

5.1 Payment Methods

Accepted payment methods are stated on your estimate or invoice. Deposits may be required for drilling work and special-order equipment.

5.2 Payment Due

Payment is due as stated on your invoice unless we have agreed otherwise in writing.

5.3 Late Payment

Past-due balances may be subject to late charges and interest to the extent permitted by law, plus reasonable costs of collection.

5.4 Disputed Charges

If you believe an invoice contains an error, contact us promptly so we can review it. We aim to resolve billing questions quickly and fairly.

6. Change Orders

Well and pump work can uncover conditions that cannot be known in advance — deeper water, rock, casing problems, or equipment failures. If the work or price needs to change materially from the estimate, we will communicate with you about the change before proceeding whenever circumstances allow.

7. Permits, Water Rights & Inspections

Well drilling in Nevada and California is regulated, including well-construction standards and water-rights requirements. You are responsible for ensuring you have the legal right to drill or modify a well on your property. We perform work in accordance with applicable licensing and well-construction regulations and file the well logs and reports required of a licensed driller.

8. Warranties

8.1 Workmanship Warranty

We warrant our workmanship as described on your written estimate or invoice. If a covered workmanship issue arises within the stated period, we will correct it as set out in that document.

8.2 Material Warranties

Pumps, pressure tanks, and other equipment carry the manufacturer's warranty, which we pass through to you. Manufacturer terms, durations, and conditions govern those items.

9. Warranty Exclusions

Warranties do not cover damage from misuse, neglect, lack of maintenance, acts of nature, power surges or electrical problems, water chemistry, freezing, tampering, changes in the water table, or work performed or altered by others. This is a summary; your written agreement controls the specific warranty terms for your job.

10. Nevada Lien Rights

Under Nevada law, contractors and suppliers who improve real property and are not paid may have the right to record a mechanic's lien against the property. We comply with applicable notice and lien requirements. Paying your invoice in full and on time avoids any need for lien action.

11. Emergency Service

We offer emergency well and pump service across our service area. Emergency or after-hours service may be billed at different rates, which we will communicate to you. Call our emergency line at (775) 230-1700.

12. Insurance Claims

If your work involves an insurance claim, you remain responsible for payment under these Terms regardless of the status or outcome of your claim, unless we agree otherwise in writing.

13. Use of Website

You agree to use this website lawfully and not to interfere with its operation, attempt to gain unauthorized access, or use it to transmit harmful code. Information on the site is provided for general guidance and may change without notice.

14. Intellectual Property

The content of this website — text, images, logos, and design — is owned by W.M. Blain or used with permission and is protected by law. You may not copy, republish, or use it for commercial purposes without our written consent.

15. Disclaimer of Warranties

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules.

18.2 Venue

Any dispute will be handled in the state or federal courts located in Nevada, and you consent to their jurisdiction.

18.3 Informal Resolution

Before filing any claim, you agree to contact us first so we can try to resolve the matter directly. Most issues can be settled with a phone call.

18.4 Class Action Waiver

To the extent permitted by law, disputes will be handled on an individual basis, and you waive the right to bring or participate in a class action.

19. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with your written estimate or invoice and our Privacy Policy, are the entire agreement between us regarding the website and our services.

20. Changes to Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version. Continued use of the website or our services after a change means you accept the updated Terms.
